Regulator finds unfair terms in Microinvest, Credit Auto and Mogo Loans contracts
Moldova’s National Commission for Financial Markets (CNPF) has found unfair terms in contracts used by three microfinance companies — Microinvest, Credit Auto and Mogo Loans. The decisions were taken between 29 September and 6 October following consumer complaints.
A Microinvest contract set a 1% penalty for each day of delay with no cap and gave the lender excessive rights to monitor the borrower’s business and assets. At Credit Auto, the regulator found unclear information on the cost of credit, a miscalculated annual percentage rate (APR) and clauses restricting customers from taking other loans, leaving the country or selling their property. At Mogo Loans, the origination fee in some contracts exceeded the legal limit.
Mogo Loans must review about 30 contracts and refund customers interest, fees, penalties and other payments — except the principal borrowed. CNPF will ask the court to declare the unfair clauses void.
What it means for you
- If you have a loan with one of these companies, reread the contract: uncapped penalties or bans on leaving the country can be challenged.
- Before signing, compare the APR and the total amount payable, not just the interest rate.
- Complaints can be filed with CNPF — consumer complaints triggered these checks.
